RESERVATION - PACKAGE - TOUR - REGISTRATION and SALE AGREEMENT

I-PAYMENTS

The full amount of the reservation must be paid at the time of registration. If the registration is not made and the payment is not made, the tour is not considered to be booked.

II- CANCELLATIONS - WITHDRAWALS – CHANGES

1- My World Way Tour Inc (MYWWT) may cancel the trip due to the fact that the required number of passengers is not registered or due to force majeure, in which case the consumer has no right to compensation. Tours canceled as a result of these reasons will be carried out on the next available date.

2- If the consumer requests a cancellation or change at least 60 days before the start of the trip, the entire fee paid in case of cancellation is refunded.
In case of cancellation and change requests within 60 days or less, a 30% deduction is applied in case of cancellation.

3- The tour may be postponed to a later suitable date, depending on the disability, if the consumer documents his reservation or his/her first degree relatives' disability and deaths with an official report to be obtained from a full-fledged state hospital and notifies them 15 days in advance via e-mail and requests it.

In case of death, the person's relative can join the tour. No refunds can be made for undeclared reasons. Therefore, for undeclared reasons, MYWWT does not claim any rights and accepts and undertakes to pay the tour fee.

4- For any reason other than force majeure, in the discounted products purchased by the consumer during the discounted sales period (early reservation campaigns); Name and date changes, transfer and cancellation requests are not accepted. In this case, the consumer agrees and undertakes to pay the entire cost of the trip to MYWWT as compensation for withdrawal.

5- MYWWT has the right to cancel all reservations made on behalf of the consumer after 24 hours, if the consumer does not notify in writing that he will participate in the trip that he missed the beginning of. No refund will be made to the consumer for such cancellations.

6- The consumer can transfer the tour to the person he/she wants until 15 days before the start of the tour. The transferee is responsible for the balance and the expenses arising from the transfer together with the transferor.

7- Force Majeure: If adverse weather conditions, road obstruction, strike, terror, war, possibility of war, unforeseen technical issues prevent the start or continuation of the tour, it is considered as force majeure by the parties.

8- Our sales are made in cash with Money Order or credit cards of banks and/or in installments with credit cards of banks. If the payment is not made in sales by credit card, the consumer is in contact with the bank with which the credit card contract is signed, the interest rates to be applied by the bank are valid, therefore MYWWT is not the addressee.

III-GENERAL PROVISIONS

1-All kinds of responsibility of the goods in the suitcases of the consumers participating in the tour belong to their owners.

2-Items that smell, flow, have flammable or explosive properties or cause discomfort to the environment, cutting, piercing and firearms and all kinds of animals are not allowed to be taken into vehicles and accommodation facilities without the express and written permission of MYWWT. Having an identity card or license for these does not change the situation.

3- MYWWT possible tour cancellation notifications can be made to each consumer individually, as well as from our website, in general, from social media networks. In this case, the notification obligation is deemed to have been fulfilled.

4- MYWWT is responsible for the changes in the tour program purchased by the consumer after the start of the tour. MYWWT may compensate the obvious changes to the detriment or damage of the consumer, in the form of a price or service refund during the trip or after the trip, pursuant to the provisions of the TÜRSAB KÜTAHYA SCHEDULE, as well as additional and/or alternative arrangements that are not included in the price and given to the consumer during the trip. may seek compensation. The purchase, use or consumption of additional or substitute services by the consumer eliminates the consumer's right to refund and compensation.

5- If the consumer leaves the tour with the belief that the service is defective, s/he must immediately notify the MYWWT official, the hotel where s/he is staying, in writing, along with the reasons, that s/he has left the tour. Otherwise, the consumer is not deemed to have left the tour and is deemed to have received and used the service.

It is the bona fide consumer's duty of care to notify the consumer of the issues they are complaining about in writing during the performance of the service.

6- The provisions of this contract, which was concluded between MYWWT and the consumer during registration, have been read by the consumer. The comsumer regarding all accommodation details of the facility; brochure-website-sales software program etc. was informed from such sources and requested and accepted that the registration be made under the same conditions on behalf of the other persons whom s/he informed that s/he would participate in the same trip with him/her.

7- The consumer(s) participating in the tour in the contract are deemed to have accepted and committed to this contract and the contract provisions of the consumer(s) they have assigned to register online on their behalf.

Despite this, in the event that the consumer(s) participating in the trip has to pay a price or compensation to MYWWT against MYWWT and related to the trip they have participated in and MYWWT has to pay the consumer a price or compensation other than the ones written in this contract, MYWWT has paid the consumer(s) who signed the contract. The right of recourse is reserved for the excess amount.

The consumers participating in this tour are deemed to have learned the terms of this agreement, which will be valid between the parties, through catalogs and advertisements, even if they have not signed, and have accepted and committed to participate in the tour under the terms of this agreement.

Legal obligations are deemed to be fulfilled by issuing a copy of this contract on behalf of the persons who will participate/participate in the trip subject to the contract and by giving a written copy to the consumer who is assigned to conclude the contract in electronic environment.

8- MYWWT acts as an intermediary before the consumers participating in the trip, hotel, carrier companies and all kinds of third parties and legal entities that provide other services related to the trip. For this reason, contrary to the agreements made between MYWWT and the institutions undertaking the transportation of the consumers who registered for the trip with their application; vehicles not being at the departure point at the times shown in their schedules, all kinds of delays and breakdowns of land, air and sea vehicles, fog, storm, blizzard and all kinds of weather conditions, road obstructions, changes in road directions and routes, strikes, terrorism, the possibility of war or against them. The main perpetrator does not have any current responsibility for similar force majeure, the fault of the user of the transportation vehicle, personal faults of third parties or unforeseen technical issues, material and moral damages, deficient or faulty services of accommodation facilities, since MYWWT is not the operator, The parties know that they are not directly responsible, such as. Therefore, MYWWT will not be liable to the consumer as the principal perpetrator and will owe an equivalent amount. In cases of such malfunctions and accidents, the consumer will first go to demand and collect their material and moral demands from the main perpetrators, and in cases where they cannot fully receive their receivables from the main perpetrator, they will be able to apply to MYWWT due to the principle of strict liability. MYWWT will be liable to its customers for the amount that cannot be collected from the main perpetrators.

9- All services included in the price are stated separately in the tour programs. Tours or services other than these are subject to an extra fee. Local agencies in the destination city or country determine and recommend the extra tour fees and contents. These tours can only be made if there is sufficient participation, and no compensation and/or refund can be claimed from MYWWT due to the lack of extra tours.

10- In matters not written in this contract, 1618 SY., 4077 SY., 4288 SY. 2634 SY., IATA, IHA..UFTAA Convention provisions, Civil aviation law, UK, TTK, International conventions including Turkey and related statutes, regulations, circulars and communiqués and the internationally accepted Frankfurter Tabelle, Turkey The provisions of the TÜRSAB Kütahya Schedule, which was implemented in Turkey, will be applied. This voucher and package tour contract, which has been prepared online between the parties, has been prepared, read, checked and accepted by the party authorities with all its annexes. The parties have mutually accepted and confirmed their commitments and actions. On behalf of the customers who will participate in the trip and whose names are written in the online reservation, he also accepts and undertakes that all legal responsibility belongs to him, against the persons who accepted this voucher and the contract and signed by proxy on behalf of the party.

11- COMPLAINTS OF SERVICE DEFECT: TÜRSAB ARBITRATION BOARD is authorized in case of defective or defective service.

SERVICE GUARANTEE: In the event that there is sufficient participation and there is no force majeure, MYWWT has agreed and committed to fulfill the above-mentioned services, independently of the advertisements and published brochures, against the price written above. In the event that MYWWT does not fulfill the above-written commitments partially or completely, it has accepted and committed to fulfill the above-mentioned services independently of the provisions of the TÜRSAB KÜTAHYA SCHEDULE for the amount of the refund to be made to the customer, against the price written above.
